Ex-SAC manager granted $5 million bail in trading case

NEW YORK (Reuters) - A former SAC Capital portfolio manager was released on $5 million bail on Monday after making his first appearance in a New York court on charges of making illegal trades that hedge fund titan Steven A. Cohen personally signed off on.

Mathew Martoma, 38, of Boca Raton, Florida, was charged last week in what U.S. prosecutors called "the most lucrative" insider-trading scheme ever.

Martoma was accused of helping Cohen's firm avoid losses and reap profits totaling $276 million in the summer of 2008 by using insider tips he obtained from a doctor about Elan Corp and Wyeth LLC. Martoma worked for CR Intrinsic, a unit of Cohen's SAC Capital.

Cohen was not charged with wrongdoing, but prosecutors have said in court papers that the "owner" of the hedge fund signed off on Martoma's recommendation to sell the shares of Elan and Wyeth. A spokesman for SAC Capital said last week that "Mr. Cohen and SAC are confident that they have acted appropriately and will continue to cooperate with the government's inquiry."

At a 13-minute hearing in U.S. district court in Manhattan on Monday, Martoma spoke only once, answering "yes, your honor" to a judge's question. He did not enter a plea.

Magistrate Judge James Cott on Monday agreed to a proposed $5 million bail package for Martoma, who has been free on similar bail conditions since appearing in a Florida court after his arrest on November 20.

Charles Stillman, Martoma's lawyer, has said he is confident his client will be exonerated. Stillman told reporters gathered outside the courtroom Monday that "we took care of business today and we'll be back another day."

Martoma worked for CR Intrinsic in Stamford, Connecticut, until 2010. He is the fifth person associated with SAC Capital, one of the most influential hedge funds, to be charged with insider trading in either a criminal or civil proceeding.

In a criminal complaint, authorities said Martoma spoke in July 2008 to the "hedge fund owner" - Cohen - and recommended selling shares of Elan and Wyeth before a negative announcement on clinical trial results for an Alzheimer's drug jointly developed by the two companies.

U.S. securities regulators, who have filed civil insider-trading charges against Martoma, contend he obtained confidential tips from Sidney Gilman, who was chair of a committee to monitor patient safety during the Alzheimer's drug's clinical trial.

Gilman, an 80-year old neurology professor at the University of Michigan, is now cooperating with prosecutors after agreeing to pay a $186,781 disgorgement. A lawyer for Gilman declined comment last week.

The Securities and Exchange Commission complaint said Gilman worked as a consultant for a so-called expert network. Hedge funds use such networks to gain insight into various industries.

According to the criminal complaint, Gilman scheduled meetings and phone calls with Martoma that allowed him to pass on new information quickly about the drug trial.

The judge set a December 26 hearing for Martoma to return to court, but Stillman said he expected it to be pushed back to a later date.

The case is USA v. Martoma, U.S. District Court for the Southern District of New York, No. 12-mag-2985.

'Bigfoot' is part human, claims study based on purported Sasquatch DNA

Because the Texas veterinarian has released no information at all about her findings (nor have they been examined by outside experts), it's impossible to evaluate the validity of her conclusions.

Genetic testing confirms the legendary Bigfoot is a human relative that arose some 15,000 years ago ? at least according to a press release issued by a company called DNA Diagnostics detailing supposed work by a Texas veterinarian.

The release and alleged study by Melba S. Ketchum also suggests such cryptids had sex with modern human females that resulted in hairy hominin hybrids, but the scientific community is dubious about her claim.

"A team of scientists can verify that their five-year long DNA study, currently under peer-review, confirms the existence of a novel hominin hybrid species, commonly called 'Bigfoot' or 'Sasquatch,' living in North America," the release reads. "Researchers' extensive DNA sequencing suggests that the legendary Sasquatch is a human relative that arose approximately 15,000 years ago."

For her study, Ketchum obtained three "whole nuclear genomes from purported?Sasquatch?samples. The genome sequencing shows that Sasquatch mtDNA is identical to modern?Homo sapiens, but Sasquatch nuDNA is a novel, unknown hominin related to?Homo sapiens?and other primate species." (Mitochondrial DNA, or mtDNA, is the DNA that resides in the cell's energy-producing structures, and is typically passed down from mothers, while nuclear DNA, nuDNA, resides in the cells' nuclei and is passed down from both parents to offspring.)

Any proof?

It's a fascinating theory.

So where's the evidence? Well, there is none. Not yet, anyway: Ketchum's research has not appeared in any peer-reviewed scientific journal, and there's no indication when that might happen. If the data are good and the science is sound, any reputable science journal would jump at the chance to be the first to publish this groundbreaking information. Until then, Ketchum has refused to let anyone else see her evidence.

Of course the?history of Bigfoot?is rife with exaggerated and premature claims about?proof of the creature's existence. For decades, various types of evidence have been offered as final, definitive proof, ranging from Bigfoot hair to blood to dead bodies. Without exception, the evidence has always been hoaxed, misidentification or inconclusive.

Because Ketchum has released no information at all about her findings (nor have they been examined by outside experts), it's impossible to evaluate the validity of her conclusions. But an important clue can be found in her statement that "Sasquatch mtDNA is identical to modern?Homo sapiens."

If the mitochontrial DNA is identical to?Homo sapiens?(i.e., modern humans), then this suggests one of two options. The first, endorsed by Ketchum, is that Bigfoot ancestors had sex with women about 15,000 years ago and created a half-human hybrid species currently hiding across North America. There is, however, another, simpler interpretation of such results: The samples were contaminated. Whatever the sample originally was ? Bigfoot, bear, human or something else ? it's possible that the people who collected and handled the specimens accidentally introduced their DNA into the sample, which can easily occur with something as innocent as a spit, sneeze or cough. No one outside of Ketchum's team knows how this alleged Bigfoot DNA was collected, from where or by whom. It could have been collected by the world's top forensics experts, or by a pair of amateur Bigfoot buffs with no evidence-gathering training.

Confirming it's Bigfoot

How did the team definitively determine that the samples were from a Bigfoot? Did they take a blood or saliva sample from?a living Bigfoot? If so, how did they get that close, and why didn't they simply capture it or photograph it? If the samples were found in the wild, how do they know it wasn't left by another animal ? or possibly even a hunter, hiker or camper who left human genetic material?

Previous alleged Bigfoot samples subjected to DNA analysis have been deemed "unknown" or "unidentified." However, "unknown" or "unidentified" results do not mean "Bigfoot." There are many reasons why a DNA sample might come back unknown, including that it was contaminated or too degraded by environmental conditions. Or it could simply mean that the animal it came from was not among the reference samples that the laboratory used for comparison. There is no reference sample of?Bigfoot DNA?to compare it with, so by definition, there cannot be a conclusive match.

Ketchum also issued a statementrequesting that the U.S. government immediately recognize Bigfoot as "an indigenous people and immediately protect their human and Constitutional rights against those who would see in their physical and cultural differences a 'license' to hunt, trap, or?kill them." Since no Bigfoot has ever been hunted, trapped or killed, it's not clear that the creatures ? if they exist ? require any special federal protection.

Ketchum's is not the only genetics-based project intended to find Bigfoot. Earlier this year, researchers from Oxford University and the Lausanne Museum of Zoology announced they were collecting samples of?alleged Bigfoot and Yeti hair?for genetic identification. Oxford geneticist Bryan Sykes collected materials from the public from May through September, and is currently conducting DNA analysis. Once the results are in, he plans to submit his results to a peer-reviewed scientific journal.

If Ketchum has the definitive proof she claims, the world will soon know about it, and Bigfoot will be proven once and for all. On the other hand, if the evidence never appears, or is inconclusive and flawed, the search will continue.

M23 rebels say they won't leave Congo city of Goma

GOMA, Congo (AP) ? Congo's M23 rebels defied a deadline imposed by neighboring nations Tuesday, saying they will stay in the crucial, eastern city of Goma and will fight the Congolese army to hold it.

Congo's military spokesman Col. Olivier Hamuli called it "a declaration of war" and said the army will resume combat, although he declined to say when.

Highlighting the volatility of the situation, a different rebel group based in Congo, known as the FDLR, crossed into neighboring Rwanda and attacked Rwandan army positions, according to villagers, eyewitnesses and Rwanda's military spokesman. It raised the possibility that Congo was directly retaliating against Rwanda, its much-smaller but more affluent neighbor, which has twice gone to war with Congo and which is now believed to be directing the M23 rebellion.

Speaking in Goma on Tuesday, M23 president Jean-Marie Runiga said the rebels will not leave the city of 1 million which they seized a week ago. The deadline imposed by the International Conference on the Great Lakes Region for the rebels to depart was midnight Monday.

Runiga said that the M23 now has 1,000 tons of arms and ammunition, including heavy artillery, abandoned by the fleeing Congo army. Six flatbed trucks carrying crates of ammunition were seen Tuesday being driven by M23 soldiers north of Goma.

At the same time, Runiga said that the rebels would like to negotiate with the Congolese government. In April, when the rebellion began, the group initially said they wanted to revisit the March 23, 2009 peace accord which paved the way for the fighters to join the Congolese military. The group initially claimed that Congo had not held up its end of the bargain, failing to provide the fighters with adequate pay and proper equipment.

Congo has already said that they are willing to negotiate with M23 on the basis of the 2009 peace accord, but on Tuesday, Runiga said that they no longer want to talk about only that. "Lots happened between 2009 and 2012. It is better to tackle the root causes of the issue once and for all," he said.

He said that for the armed group to leave Goma, Congo is going to have to agree to a new set of conditions.

Runiga addressed reporters in the center of Goma, almost 12 hours after the midnight deadline for their retreat had passed. Female ushers led reporters to their chairs. All of them were wearing Mushanana fabric, a toga-like dress typically worn by Rwandan women. The visual detail emphasized the foreign provenance of the rebels now occupying Goma, who according to the findings of the United Nations Group of Experts are financed by Rwanda, which is providing them with arms, sophisticated communications equipment as well as several battalions of troops.

"They have refused to leave the city of Goma. This is a declaration of war, and we intend to resume combat," said Congo's military spokesman, Hamuli, whose troops have been pushed back to the town of Minova, 60 kilometers (36 miles) outside of Goma. Asked when, he said: "Arrangements are being made by the FARDC (the Congolese military) hierarchy."

The M23 was created nearly eight months ago by former rebels who joined, and then defected from the Congolese army. They have been accused of human rights abuses, including executions and forced recruitment of children.

In a worrying development, fighting erupted about 30 kilometers (18 miles) north of Goma in Kibumba, near the Rwandan at around 5 a.m., said an M23 officer and Kibumba residents.

Hours later AP journalists saw rebels believed to be FDLR, a group that is believed to have received financial support from Congo, retreating back into Congo from the border. About 100 M23 fighters were pursuing the fighters from the FDLR, the French acronym for the Democratic Forces for the Liberation of Rwanda.

Rwanda's military spokesman Brig. Gen. Joseph Nzabamwita confirmed that the FDLR attacked Rwandan positions on Tuesday at dawn. "The attack on Cyanzarwe, Bugeshi Sector on Rubavu district was carried out by two companies of FDLR fighters of about 150 men," he said. "We managed to repulse them and send them back to DR Congo while others dispersed into different directions," he said.

He said two of the attackers were captured and are currently undergoing questioning while the Rwandan forces have intensified patrols on the border with Congo.

M23 soldiers Tuesday told residents in the area to go to Goma for their safety.

Both the M23 and the FDLR rebel groups have their origins in the scars left by Rwanda's 1994 genocide. The perpetrators of that genocide were from the Hutu ethnic group, and 18 years ago, at the end of the 100-day massacre they fled across the border and took refuge in the jungles of eastern Congo. Their leaders regrouped under the banner of the FDLR, and have used Congo as a base to try to take back Rwanda. Numerous reports indicate that the FDLR was tacitly backed by Congo, which wanted to use them as a buffer against Rwanda.

By contrast the M23 are fighters who are mainly from the Tutsi ethnic group that was targeted for extermination during the genocide.

Amid Hurricane Sandy, a Race to Get a Liver Transplant

It was the best possible news, at the worst possible time.

The phone call from the hospital brought the message that Dolores and Vin Dreeland had long hoped for, ever since their daughter Natalia, 4, had been put on the waiting list for a liver transplant. The time had come.

They bundled her into the car for the 50-mile trip from their home in Long Valley, N.J., to NewYork-Presbyterian Morgan Stanley Children?s Hospital in Manhattan. But it soon seemed that this chance to save Natalia?s life might be just out of reach.

The date was Sunday, Oct. 28, and Hurricane Sandy, the worst storm to hit the East Coast in decades, was bearing down on New York. Airports and bridges would soon close, but the donated organ was in Nevada, five hours away. The time window in which a plane carrying the liver would be able to land in the region was rapidly closing.

In a hospital room, Natalia watched cartoons. Her parents watched the clock, and the weather. ?Our anxiety was through the roof,? Mrs. Dreeland said. ?It just made your stomach into knots.?

The Dreelands, who are in their 60s, became Natalia?s foster parents in 2008 when she was 7 months old, and adopted her just before she turned 2. They have another adopted daughter, Dorothy Jane, who is 17.

Natalia is a ?smart little cookie? who loves school and dressing up Alice, her favorite doll, her mother said. At age 3, Natalia used the word ?discombobulated? correctly, Mr. Dreeland said.

Natalia?s health problems date back several years. Her gallbladder was taken out in 2010, and about half her liver was removed in 2011. The underlying problem was a rare disease, Langerhans cell histiocytosis. It causes a tremendous overgrowth of a type of cell in the immune system and can damage organs. Drugs can sometimes keep it in check, but they did not work for Natalia.

In her case, the disease struck the bile ducts, which led to progressive liver damage. ?She would have eventually gone into liver failure,? said Dr. Nadia Ovchinsky, a pediatric liver transplant specialist at NewYork-Presbyterian. ?And she demonstrated some signs of early liver failure.?

The only hope was a transplant.

Mr. Brown told Dr. Kato that they might have to decline the organ. Dr. Kato, soft-spoken but relentless, said, ?Find somebody who can fly.?

Dr. Kato used to work in Miami, where pilots found ways to bypass hurricanes to deliver organs. Even during Hurricane Katrina, his hospital performed transplants.

?I asked the transplant coordinators to just keep pushing,? he said.

Mr. Brown said, ?Dr. Kato knew he was going to get that organ, one way or another.?

As the trajectory of the storm became clearer, one of the West Coast charter companies agreed to attempt the flight. The plan was to land at the airport in Teterboro, N.J. The backup was Newark airport, and the second backup was Albany, from where an ambulance would finish the trip.

The timing was critical: organs deteriorate outside the body, and ideally a liver should be transplanted within 12 hours of being removed.

Early Monday, as the storm whirled offshore, the plane landed at Teterboro. Soon a nurse rushed to tell the Dreelands that she had just seen an ambulance with lights and sirens screech up to the hospital. Someone had jumped out carrying a container.

At about 5 a.m., the couple kissed Natalia and saw her wheeled off to the operating room.

Three weeks later, she is back home, on the mend. The complicated regimen of drugs that transplant patients need is tough on a child, but she is getting through it, her father said.

Google Launches "Defend Your Net" to Protest German Copyright ...

For Google, what is happening in Germany right now is a very big issue. If the German?Bundestag (government) gets its way, the search giant could be forced to remove publisher content and made to pay for the snippets it displays in search results.

Recognising that its German users may find it difficult to find the information they seek, Google has today launched a new campaign in the country called ?Defend Your Net,? setting up a new portal designed to educate and mobilise its users to help protect the information it collects.

On this small portal, Google spells out what it believes will happen should German politicians side with publishers and force it to remove content from its search results. It?explains that a change in the law could mean ?higher costs, less information and massive legal uncertainty.?Bloggers, politicians, the German economy and leading scientists reject this venture.?

Google suggests such a law could damage the German economy, threaten the diversity of information, result in massive legal uncertainty, set back?innovative media and copyright and cause a ?market economy paradox.?

Later this month a proposed new section to the German Copyright Act is due to be discussed in Germany?s parliament, the Bundestag. The new section, if introduced, would provide the ?producer of news materials? the general ?exclusive right to make said materials publicly available, in whole or in part, for commercial purposes.?

Others would be permitted to provide ?public access? to the publishers? material unless those providing that access are ?commercial operators of search engines or commercial providers of services that aggregate this content in a respective fashion?. News publishers? right to control the commercial exploitation of their work in this regard would extend for a year after publication. Authors of the work would be entitled to be ?provided with a reasonable share of the remunerations issuing from the author?s work?.

The search giant argues that publishers already have the tools at their disposal to opt out of Google?s search results and it doesn?t profit from such news as its Google News service is completely free of advertising. In fact, Google says that it even directs as many as 45 percent of one German news website?s readers via its Google.de search engine.

To fight the law, Google asks German users fill out a web form notifying the company of their views on the proposed changes (perhaps protest would be a better word). It also lists a page where visitors can locate their local member of parliament and voice their opposition to the new copyright law.

Google?s search and News service already directs four billion hits to publishers globally, equating to roughly 100,000 clicks per minute. The company reminds publishers that if they do not want to appear in its search or on Google News, they can unsubscribe easily with a short text code ? meaning ?an ?intellectual property right? is not required.?

American astronaut Scott Kelly and Russian cosmonaut Mikhail Kornienko will launch on the?one-year space station flight?in spring 2015 and return to Earth in spring 2016, NASA officials announced today (Nov. 26). They will begin their mission training in early 2013.

The mission will help NASA understand how the human body adapts to extremely long space missions, such as voyages around the moon, to an asteroid and ultimately to Mars, NASA officials said.

"Congratulations to Scott and Mikhail on their selection for this important mission," William Gerstenmaier, NASA's associate administrator for Human Exploration and Operations in Washington, said in a statement. "Their skills and previous experience aboard the space station align with the mission's requirements. The one-year increment will expand the bounds of how we live and work in space and will increase our knowledge regarding the effects of microgravity on humans as we prepare for future missions beyond low-Earth orbit." NASA is developing spacecraft and mission plans to send astronauts to visit a near-Earth asteroid by 2025, a goal set by President Barack Obama. The space agency is also reportedly studying potential?manned missions back to the moon.

Kelly, 48, is a U.S. Navy captain who has flown on two space shuttle missions and one long-duration expedition on the International Space Station. He commanded the space station's Expedition 26 mission in 2010 during his third spaceflight.

Kelly hails from West Orange, N.J., and joined NASA's astronaut corps in 1996. His identical twin brother Mark Kelly also served as a Navy captain and NASA astronaut before retiring from the military and spaceflight in 2011.

Kornienko, 52, is also a veteran spaceflyer. The native of Syzran in Russia's Kuibyshev region is a former paratrooper officer who joined Russia's cosmonaut corps in 1998. Kornienko spent more than 176 days in space as a flight engineer on the station's Expedition 23 and 24 crews.

NASA and Russia announced plans for the one-year space station voyage earlier this year.?Rumors of the flight?were circling prior to the announcement, with the Russian news agency Interfax suggesting that veteran NASA astronaut Peggy Whitson ?a veteran station commander ?as a potential choice for the American crewmember. Whitson stepped down from her position as NASA's Chief Astronaut earlier this year to rejoin the agency's active spaceflying ranks.

Today's announcement, however, puts that theory to rest.

"Selection of the candidate for the one year mission was thorough and difficult due to the number of suitable candidates from the Cosmonaut? corps," Vladimir Popovkin, the head of Russian Federal Space Agency, said in a statement. "We have chosen the most responsible, skilled and enthusiastic crew members to expand space exploration, and we have full confidence in them."

The 2015 space station flight by Kelly and Kornienko will be the longest mission to the?International Space Station, but not the longest continuous spaceflight. That record is held by cosmonaut Valery Polyakov, who lived aboard Russia's Mir space station from January 1994 until March 1995, ultimately spending 438 consecutive days in orbit.

The International Space Station is the product of cooperation by NASA, Russia and the space agencies of Europe, Japan and Canada. Construction of the $100 billion space station began in 1998 with the first crew taking up residence in 2000. Astronauts and cosmonauts have lived on the space station in rotating crews ever since.

Study links improved consumer welfare to increased prescription drug advertising efforts

More people are better off thanks to the impact of an influx of direct-to-consumer advertising spending than they would be without those marketing efforts, according to a study recently published by Jayani Jayawardhana, an assistant professor in the University of Georgia College of Public Health.

The multi-year study focused on advertising efforts surrounding cholesterol-reducing prescription medications. Jayawardhana found increased levels of consumer welfare due to direct-to-consumer advertising than when compared to situations without this type of marketing. Her research, which was published in the International Journal of Industrial Organization, concludes that such efforts also spurred under-diagnosed patients to seek medical treatment.

Federal deregulation of prescription drug marketing in 1997 lowered cost barriers and enabled manufacturers to advertise prescription drugs without including a detailed summary of the product. Since the relaxation of those rules, advertising spending from pharmaceutical companies has increased by more than 200 percent.

Jayawardhana, a health economist in the college's department of health policy and management, said her study was the first to provide an analysis of consumer welfare that demonstrated a connection to the increased marketing expenditures. It also adds further support to existing academic research suggesting that direct-to-consumer advertising efforts lead to a more informed and more inquisitive consumer, which could lead to better health outcomes.

"Let's say you see a commercial for Lipitor, and you suspect that you have high cholesterol, so you come and ask for that drug from the physician," Jayawardhana said. "For whatever reason, the doctor may assume that isn't the best drug for you, and you get prescribed Zocor instead. The point isn't that you didn't get the drug you saw on the commercial but rather that you came to the doctor and got treatment for your condition, which leads to welfare improvement."

Because of the role of physician in the decision-making process, pharmaceutical companies have to market their drugs to the two purchasing agents involved -- the consumer and the physician.

"When you see an advertisement for something like Coke, the intent is to give you an incentive to go buy the product," she said. "But with the prescription drug market, the consumer is not the final decision maker. You have to go through a gatekeeper in the physician."

Jayawardhana's research indicates those advertising efforts-to both consumers and physicians-are paying off. In addition to heightened consumer awareness, targeted advertising toward physicians has both an informative and persuasive effect on the selection of the drug.

Jayawardhana, who holds master's and doctoral degrees in economics from the University of Virginia, said critics of the federal deregulation have suggested the marketing spending boom could lead to a myriad of harmful results-such as patients requesting and receiving inappropriate drugs or higher dosages than necessary from their physician.

While such incidents may be possible, it is difficult to recognize such outcomes in the data. However, because physicians act as gatekeepers for prescription drugs and consumers have limited access to advertised products, such negative outcomes may be scarce, she said.

Not your average beef spaghetti, instead of standard bolognese sauce, they use rendang sauce which is famous known for its richness flavors and also with mince beef and quail eggs. Good thing that the rendang was not as spicy as I expected.

Spaghetti aglio e olio cooked with Wafu sauce, completed with fried oxtail and red bell pepper. Frankly speaking, I was not really keen to see the red chili paste on the top of this spaghetti aglio e olio.

The authentic taste of Indonesian traditional fried rice cooked with salted fish and shrimp paste. For the combination with Japanese dishes , use Angus beef in Teriyaki sauce and also completing with egg on top. The Angus beef was nice. The fried rice was tasty but too spicy because of the chili seeds.

Indonesian Grilled Ribs Spaghetti - Rp. 65.000

Spaghetti Aglio Olio cooked with Wafu sauce, completed with grilled ribs and fried white onion. Also served with 2 types of chili paste: red chili and green chili. If you are a chili lover, you will definitely love this dish but for me, after I ate a spoon of it, my lips and?tongue?felt like they were on fire :(

At the end of this food tasting, it was hard for me to enjoy the food because I'm not a chili person. There are so many Indonesian food without chili. Why all these pastas and pizza need to have chili? Does food with chili really represent Indonesian food? I understand a lot of people love chili but there are people and also children who can not tolerate it. I guess it would be wise to add other non chili pasta and pizza with Indonesian twist to the menu.

Intrade boots US customers after federal charges

WASHINGTON (AP) ? Intrade, the online prediction market that gained popularity as an informal oddsmaker for the presidential election, shut itself to U.S. customers Monday after regulators charged it with illegally facilitating bets on future economic data, the price of gold and even acts of war.

Hours after the Commodity Futures Trading Commission filed a complaint in federal court, Intrade posted in its user forum and on its news page that it could no longer allow U.S. residents to trade "due to legal and regulatory pressures."

U.S. residents must begin closing their accounts and withdrawing their funds immediately, the website said. It said customers must resolve open predictions by Dec. 23 or the site would assign them "fair market value" and close them.

The CFTC's civil complaint charged that Intrade and its operator solicited customers to trade investment contracts that technically are options. Options must be traded on approved, regulated exchanges.

"Today's action should make it clear that we will intervene in the 'prediction' markets, wherever they may be based, when their U.S. activities violate" laws and rules enforced by the agency, CFTC enforcement director David Meister said in a statement.

By requiring that options be traded on approved exchanges, Meister said, regulators can "police market activity and protect market integrity."

Intrade did not respond to an emailed request for comment.

It was unclear whether regulators believe that all trades on Intrade by U.S. investors are illegal. The CFTC said it would not comment further because the matter was in litigation.

Intrade is known for facilitating bets on award shows, weather and other high-profile events. The prices at which customers are willing to make those bets are cited as informal odds. TEN also used to allow betting on sports through other sites that it operated.

For example, on Monday the site gave "Argo" a 28.5 percent chance of winning the Oscar for best picture and assigned a 19 percent chance that the United States or Israel would launch an airstrike against Iran by June 30.

The CFTC oversees markets for futures and options, investments that allow people to bet on the future prices of commodities like grain and oil. Those contracts help farms, airlines and other businesses to protect themselves against unexpected price swings.

In the complaint, the CFTC alleged that Intrade, based in Ireland, had illegally solicited everyday U.S. investors to use the website between September 2007 and June 25 of this year.

Intrade and its operator, Trade Exchange Network Ltd., falsely claimed in annual reports that the contracts were not being sold to ordinary U.S. customers, the CFTC said. Regulators want the companies to pay fines and return profits that were obtained illegally. They want the site and its operators barred from any future activities related to options trading.

Intrade users reported on Twitter that the site already blocks them from trading contracts related to the prices of oil and gold.

One of them, Joe Schilling, posted an image of an email he said was sent by Intrade in 2009, stating that crude oil and gold contracts were unavailable to U.S. users "due to a regulatory request" from the CFTC.

TEN settled similar charges of soliciting U.S. investors in 2005. In an order filed with that settlement, the CFTC said that U.S. customers accounted for up to 40 percent of Intrade's total customer base. TEN paid $150,000 and agreed to halt further violations.

Under the settlement, TEN agreed to use pop-up windows to tell U.S. customers which bets were not available to them. It said it would cooperate in any future investigations.

Monday's complaint includes charges that TEN violated that earlier settlement. The company used Intrade to offer illegal options including on the future prices of gold, changes in the unemployment rate and a measure of U.S. economic output, the complaint said. It said TEN failed to provide the pop-up notices mandated in the 2005 order.

"The economy is expected to grow 2.5 percent next year, and with modest job creation, assuming there is no fiscal cliff, the demand for commercial space will gradually rise.? The greatest friction that remains is a tight credit environment, notably for smaller properties."

Vacancy rates over the next four quarters are forecast to decline 1.0 percentage point in the office market, 0.6 point in industrial, 0.2 point for retail and 0.1 point in multifamily; however, multifamily has the tightest availability and is experiencing the strongest rent increases, well above the rate of inflation.

"The primary factor holding back greater job creation has been uncertainty over regulations and associated costs," Yun said.? "With the elections behind us and Washington apparently resolved to prevent a fiscal cliff, it's hoped that ambiguity over regulatory issues will clear relatively soon so employers can understand the rules of the game and the layout of the field."

NAR's latest Commercial Real Estate Outlook? offers projections for four major commercial sectors and analyzes quarterly data in the office, industrial, retail and multifamily markets.? Historic data for metro areas were provided by REIS, Inc., a source of commercial real estate performance information.

Office Markets

Vacancy rates in the office sector are projected to fall from an estimated 16.7 percent in the fourth quarter to 15.7 percent in the fourth quarter of 2013.

The markets with the lowest office vacancy rates presently (in the fourth quarter) are Washington, D.C., with a vacancy rate of 9.6 percent; New York City, at 10.1 percent; and New Orleans, 12.9 percent.

Office rent is expected to increase 2.0 percent this year and 2.5 percent in 2013.? Net absorption of office space in the U.S., which includes the leasing of new space coming on the market as well as space in existing properties, is likely to total 21.7 million square feet in 2012 and 49.0 million next year.

Industrial Markets

Industrial vacancy rates should decline from 10.1 percent in the fourth quarter of this year to 9.5 percent in the fourth quarter of 2013.

The areas with the lowest industrial vacancy rates currently are Orange County, Calif., with a vacancy rate of 4.3 percent; Los Angeles, 4.4 percent; and Miami at 6.5 percent.

Annual industrial rent is forecast to rise 1.7 percent in 2012 and 2.2 percent next year.? Net absorption of industrial space nationally will probably total 93.4 million square feet this year and 89.6 million in 2013.

Retail Markets

Retail vacancy rates are expected to ease from 10.8 percent in the fourth quarter to 10.6 percent in the fourth quarter of 2013.

Presently, markets with the lowest retail vacancy rates include San Francisco and Fairfield County, Conn., both at 3.9 percent; Long Island, N.Y., 5.1 percent; and Orange County, Calif., 5.4 percent.

Average retail rent should increase 0.8 percent this year and 1.4 percent in 2013.? Net absorption of retail space is estimated to be 9.1 million square feet this year and 19.8 million in 2013.

Multifamily Markets

The apartment rental market - multifamily housing - is projected to see vacancy rates decline from 4.0 percent in the fourth quarter to 3.9 percent in the fourth quarter of 2013; vacancy rates below 5 percent are considered a landlord's market with demand justifying higher rents.

Areas with the lowest multifamily vacancy rates currently are Portland, Ore., at 2.1 percent; New York City, 2.2 percent; and Minneapolis, 2.3 percent.

Average apartment rent should increase 4.1 percent in 2012 and another 4.6 percent next year.? Multifamily net absorption is likely to be 219,700 units this year and 234,600 in 2013.

Global companies are taking steps to make their employee mobility programs more accessible and attractive, according to PwC?s 2012 Survey of Global Mobility Policies. Companies are adopting new non-traditional workforce mobility programs, such as frequent business travel; they are also relying on commuter and short-term assignments in place of longer-term assignments. These new programs are also broader in reach, affecting more than 10 percent of employees, compared to traditional short- and long-term programs that impact only 1 percent.

The survey, which provides a perspective on the ways corporate mobility programs have evolved over the decade 2002-2012, reflects how businesses are responding to major changes in workplace demographics, technology and a globalizing economy. For example, companies are increasingly committed to reviewing and updating their employee mobility programs; half (50 percent) of participants reported that they are focused on refining their policies, while 48 percent want to simplify administration. Ten years ago the top two areas of focus were cost reduction and regional policy development.

?In today?s highly competitive global marketplace, the structure and appropriateness of global mobility policies can significantly impact your organization?s workforce,? said Eileen Mullaney, principal and U.S. Global Mobility Consulting leader the International Assignment Services (IAS) practice of PwC US. ?These days it is all about choice. Mobility packages should offer multiple options so business leaders as well as the employees can choose what works best for their specific situations or interests.?

Additional survey findings demonstrate the changing nature of mobility programs. In 2012,

  • Forty-six percent offered permanent transfer policies, compared with 29 percent in 2002;
  • Thirty-seven percent had localization policies, compared with 20 percent in 2002;
  • Twenty-six percent offered graduate training policies, compared with 14 percent in 2002;
  • Twenty-one percent offered commuter policies, compared with 8 percent in 2002; and
  • Seventy-one percent had extended business travel policies, compared with 30 percent in 2002.

The changes in mobility programs reflect the need to match evolving economic and workforce demands. Increasing business globalization and activity in emerging markets, younger employees seeking international work opportunities early and often in their careers, as well as a focus on developing future leaders with global mobility experience are leading companies to take a more strategic approach to mobility that better aligns the programs with business growth objectives and longer-term talent and career development plans.

According to the survey, the demographics of mobility program participants have broadened to become less focused on employees who come from headquarters locations or who are at the executive level; for example, less than 50 percent of participants came from headquarters in 2012, compared to 80 percent in 2002. There has also been a marked decline in executive-level assignments (more than 60 percent since 1992) in favor of developmental assignments and technical and subject matter expert roles.
